Keith G. Napolitano Jr. is a DWI defense lawyer with experience in complex DWI litigation, including defending clients facing second and third offense penalties. He has a proven track record in getting DWI charges dismissed, saving clients’ driving privileges, and helping clients avoid jail time. At the Municipal Court level, Keith has successfully argued suppression issues, including destruction of evidence, unlawful stop and detentions, and breath/blood testing issues which have led to suppression of chemical test results for his clients. He has also argued numerous Post Conviction Relief petitions in Municipal Court, getting clients’ relief under State v. Laurick, State v. Barboza, and the newly decided State v. Zingis.
At the Superior Court level, Mr. Napolitano has experience in litigating criminal matters pertaining to or relating to certain criminal driving offenses, where there is an underlying DWI, including: assault, CDS possession, unlawful weapons possessions, child endangerment, and driving while suspended. He has kept numerous clients from having criminal records, losing their children, losing their constitutional right to carry/own firearms, losing driving privileges, and from serving otherwise mandatory jail time on certain criminal offenses. He also has knowledge and experience litigating Graves Act cases which pertain to weapons possession. Keith has served clients in every Superior Court in NJ.
In terms of appellate work, Keith has argued before the New Jersey Appellate Division and Law Division on numerous issues, including reasonable suspicion for motor vehicle stops, operation of a motor vehicle, and impairment beyond a reasonable doubt. Additionally, Mr. Napolitano has argued before the Law Division and Appellate Division on issues relating to Post Conviction Relief petitions with success in having prior DWI convictions vacated and overturned. He has been before the Law Division in every county in New Jersey. He has also assisted in filings for the pending landmark Supreme Court matter State v. Cunningham.

Graduate Degree: Liberty University, 2018, Masters in Public Health (focus in Global Health/epidemiology).
Law Degree: Appalachian School of Law, 2022, J.D.; Student Government Senator, Honors graduate; received Criminal Law Practice Certificate for Municipal and Superior Court.
