The penalties in New Jersey for driving while intoxicated can be devastating. Take the following into consideration:
Penalties For A 1st Offense
In NJ, if you are arrested for drunk driving and it is the first offense, you face:
- 3 months to 1-year license suspension
- Up to 30 days in jail
- Thousands of dollars in fines
You may also be required to use the Ignition Interlock Device depending on the circumstances. If you refuse to take the chemical test, you will automatically have your license suspended for 7 months and will be subject to additional fines.
Penalties For A 2nd Offense
If this is the second offense, you could have to deal with penalties like:
- A minimum two-year suspension of your license
- Up to 90 days in jail
- Community service
- Required time spent learning in a Driver Resource Center
- Additional fines
- An Ignition Interlock Device
Penalties For A 3rd Offense
If you are facing a possible 3rd offense, you may find yourself dealing with:
- 180 days in jail
- 90 days of community service
- License suspension of 10 years
- Required learning at a Driver Resource Center
If the arrest takes place for drunk driving while in a school zone, the penalties become much harsher.
You can’t afford to wait – contact our highly rated attorneys now to learn more about how we can help you minimize or eradicate the penalties you face.

Did you know that your case will be heard before a Municipal Court Judge and that the ultimate resolution of your case will happen within 60 days of your arrest? This is why it’s so important that you contact an experienced DWI attorney as soon as possible after your arrest.
Even if you’ve had a blood, urine, or breathalyzer test, remember that no test is 100% accurate and that police officers are humans who make mistakes. Our legal team fully reviews your case and determines if any of the results can be challenged in court.
It is the State’s responsibility to show that you were driving while impaired and in order to obtain a legal conviction, they must show that:
- You were driving a vehicle in New Jersey.
- The traffic stop was lawful.
- The arrest was done properly.
In addition to this, any testing must be collected and admitted into evidence.
If there are no chemical tests, then the state must prove impairment based on how you interacted with the police officers and witnesses.
Again, there are many ways in which mistakes can be made, or special circumstances not taken into consideration. You can rest easy knowing that we will fully review your case and build a defense specifically tailored for you. Our promise to you is that we will aggressively and professionally present that defense to the judge on your behalf. Don’t worry – you aren’t alone.

You’ve been arrested for a DWI. Now what happens?
In each case, we prepare our clients for what will occur during their DWI defense journey. This includes:
- Arraignment: This is a formal hearing during which the court will charge you with a traffic offense and you will issue your plea.
- Pre-Trial Conference: This is the first court date. In some cases, the matter will be resolved immediately, however, typically a postponement occurs and you will be given time to obtain full “discovery”. This means you are given additional time to build your defense.
- Suppression Hearing: If our legal team determines that your rights are violated, a suppression hearing may be held to have certain evidence suppressed.
- Judge Trial: This is the trial that will typically be held within 60 days of your arrest.
- Sentencing: If you are found guilty this is when you will find out which penalties will be applied to your case.
- Appeal: It is possible to win cases through an appeal.
Our attorneys will answer all of your questions and prepare you for what is to come. You have limited time – call us now.
